Application for Additional Assisted Living Program Beds in Niagara County

As a result of recommendations contained in the study by the Commission of Health Care Facilities in the 21st Century (a.k.a The Berger Commission Report), the New York State Department of Health is soliciting applications for Assisted Living Program (ALP) beds. The bed distribution is limited to 100 ALP beds in Niagara County. Applicants from all New York State counties are eligible to apply.

Application for Additional Assisted Living Program Beds

On June 4, 2008, New York State Health Commissioner Richard F. Daines, M.D. announced approval of 1,584 new Assisted Living Program beds.

For those applicants that were not selected, an administrative review may be requested. The applicant has the right to dispute the decision before a hearing officer designated by this Department. The request for a hearing must be submitted in writing. Requests for a hearing must be submitted by August 4, 2008 to be considered. This letter must be sent to:

At a hearing the applicant will have the right to be represented by counsel or other representative(s), to produce witnesses and other evidence on their behalf, to request the issuance of subpoenas and to examine witnesses testifying against them and evidence presented against them. All witnesses will be sworn and a verbatim record of the hearing will be made.
