State Health Department Issues Enforcement Actions Against Tobacco Vendors Selling to Minors
ALBANY, January 8, 2003 – The New York State Department of Health fined 127 tobacco vendors a total of $42,250, that were found in violation of the State’s Adolescent Tobacco Use Prevention Act (ATUPA) from October 1, 2001 to September 30, 2002. Violations included selling tobacco products to minors and or selling tobacco while their registration to sell tobacco was suspended or revoked. Altogether, statewide 12,731 tobacco vendors have been fined a total $4.5 million since the program began in 1997. These youth enforcement activities continue to build on New York’s $53 million comprehensive anti-smoking program.
New York City and county health departments have the primary responsibility to enforce the ATUPA law, which prohibits the sale of all tobacco products to persons under eighteen years of age. In the 22 counties without full service local health departments, the State Health Department performs the ATUPA duties.
The information provided in this release is required to be made public under New York State Public Health Law. Additionally, to enhance public awareness and to further deter businesses from selling tobacco products to minors, the law mandates the names and addresses of businesses that engage in illegal tobacco sales to be published in local newspapers.
The New York State Public Health Law provides all violators the opportunity for a hearing and an appeal before an administrative tribunal representative. Enforcement actions under ATUPA include the following:
- A first violation carries fines ranging from $300 to $1,000.
- Subsequent violations will result in fines from $500 to $1,500.
- A $50 surcharge for each violation.
- For all sales to minor violations by retailer tobacco vendors, two points are assigned (or one point, if the retailer proves the seller is certified as a result of successfully completing a state certified sales training program).
- The accumulation of three points will result in a six-month suspension of a retailer’s registration to sell tobacco and if they are lottery agents, a six-month suspension of their lottery license.
- Retailer registrations and lottery licenses will be revoked for one year for any four violations of the law that occur within a three-year period.
- Sale of tobacco by a vendor with a suspended registration could result in a permanent revocation and a $2,500 fine.
In the first four program years since Governor Pataki signed legislation providing funding to support the tobacco youth enforcement program, more than 132,030 retailer compliance inspections were conducted with more than 91,434 performed with the assistance of minors attempting to purchase over-the-counter tobacco products. The vendor compliance rate has increased to 89 percent.
